The problem

CUSMA is not automatic. It is a claim you have to make, every time.

The most expensive misunderstanding in Canadian cross-border ecommerce is the belief that CUSMA makes Canadian goods duty-free. It does not. CUSMA makes qualifying goods duty-free when the importer claims preferential treatment and can support it with a certification of origin.

No claim, no exemption. The entry is filed at the most-favoured-nation rate, duty is assessed, the carrier pays it, and you are billed — for goods that were entitled to enter at zero.

Worse, the two failure modes look identical on your invoice. A product that genuinely does not qualify and a qualifying product with no certification attached both show up as "duty charged." Without a per-SKU eligibility determination you cannot tell which is which, so you assume the duty is correct and move on.

Questions worth asking

If my product is made in Canada, is it not automatically CUSMA-eligible?
No, on two counts. First, eligibility depends on meeting the specific rule of origin for that product’s tariff classification, which for goods with imported inputs can require a tariff shift or a regional value content threshold rather than simply final assembly in Canada. Second, even a fully qualifying good is charged duty unless preferential treatment is claimed at entry and supported by a certification of origin.
How do I claim CUSMA when shipping by UPS or FedEx?
The claim has to reach the entry, which means the certification data has to be on the commercial invoice or transmitted with the shipment, and the broker has to actually apply the preference. In practice this fails because the certification is not attached, or it is attached but incomplete. OriginProof makes the claim part of the label process so it stops depending on anyone remembering.
What if only some of my products qualify?
That is the normal case, and it is why a per-SKU determination matters. Claiming preference on goods that do not qualify is a compliance problem, not a saving. We separate the catalogue properly.
Can I get back duty I have already paid?
Often yes, where the goods qualified and the entry is within the applicable window for a post-entry claim. The specifics depend on entry type. We review your history and tell you what is realistically recoverable before you commit to anything.
Do I need a customs broker as well?
You likely already have one through your carrier. OriginProof gives that broker a correct, complete claim to work with, which is usually the missing piece.
What happens if we are audited on an origin claim?
Preference claims are verifiable and the importer must be able to support them. The record keeping is not optional, which is why it is part of the service rather than an add-on.
