USMCA duty refunds for ecommerce brands

Duty paid in error on qualifying goods is not necessarily gone. Where the good met the rule of origin and the entry falls within the applicable window, a post-entry claim can recover it. The hard part is identifying which entries qualify.

The claim depends on three things

The good qualified. You need a defensible origin determination for the SKU as it was at the time of entry, with supporting records.

The entry is identifiable. Courier shipments are often entered in consolidated ways that make locating a specific entry non-trivial. This is usually the practical obstacle.

You are inside the window. Post-entry claims for preferential treatment are time-limited. Waiting costs you the oldest months first.

Why ecommerce makes this harder than it sounds

A traditional importer has a manageable number of large entries with clear paperwork. An ecommerce brand has thousands of small courier parcels, entered by the carrier’s broker, billed in aggregate, with duty appearing on an invoice keyed by tracking number.

Reconstructing which parcels contained qualifying goods, what duty was assessed on each, and how those parcels were entered is a data exercise before it is a customs exercise. This is why most brands never attempt it.

Doing it in the right order

First, determine eligibility per SKU. Without this, nothing downstream is defensible.

Second, reconcile your duty invoices against orders so you know which shipments contained qualifying goods and what was charged.

Third, stop the ongoing leak by getting certifications onto current shipments. The forward-looking fix is worth more than the refund and takes effect immediately.

Fourth, pursue recovery on the historical entries that are both eligible and worth the effort.

Set expectations honestly

Not every dollar is recoverable. Entry type, documentation quality and timing all constrain what can realistically be claimed, and small-value courier entries are not uniformly worth pursuing.
